Introduction

I*LEVEL INCORPORATED has created this privacy policy to demonstrate our firm commitment to protecting the privacy of personally identifiable information collected via our web-native application (i.e. our assessment tools). Our goal is to be our customers’ trusted location on the Internet for collecting important information about and from their employees and candidates. Our web-native application collects sensitive business and personal information from our customers and their employees and candidates, and we want you to be aware of how carefully we safeguard such information.

This privacy policy governs your interaction with the I*LEVEL website and your use of our online services. If you are a customer of ours and have an agreement with us that conflicts with this policy, that agreement will supersede this policy to the extent of such conflict. Please note that we review our privacy practices from time to time, and accordingly, our practices are subject to change. We ask that you bookmark and periodically review our privacy policy to ensure continuing familiarity with the most current version. With respect to our customers who are registered users and our customers’ employees and employment candidates who participate in assessments, I*LEVEL may collect and/or monitor, in aggregate and individual form, personally identifiable facts or data including, among other things, the following information:

I*LEVEL also collects information that uniquely identifies each user, such as which pages of our website are visited, the order in which they are visited and which hyperlinks are clicked. In addition, I*LEVEL collects personally identifiable information from users who provide such information through our “Contact Us” page or otherwise. If you have provided personally identifiable information to us, are not a customer or employee or employment candidate of a customer of ours and decide that you would like to request that we no longer contact you, please contact us through our “Contact Us” page. We do not collect personally identifiable information from children, or minors younger than 13 years of age. If you provide us with any personally identifiable information, you represent that you are at least 13 years of age.

I*LEVEL will not sell, share, or rent personally identifiable information of any registered user or assessment participant of any customer to any person or entity outside of I*LEVEL and its affiliates other than such customer and such customer’s designees, except in the following circumstances: (i) when required to comply with the law or a legal process such as a court order, subpoena, search warrant or discovery in legal proceedings, (ii) when the person who provided such information has violated or is reasonably suspected of violating our Terms of Use or partakes or is reasonably suspected of partaking in illegal activity, (iii) when we use third parties to assist us in processing and maintaining such information or contacting or providing information to you and such third parties agree to maintain the confidentiality of such information and (iv) in connection with a merger or sale of assets or portions of our business. Please keep in mind that we cannot and do not assume any responsibility for actions or omissions of third parties.

How We Use Cookies

Many features of our web-native application require the use of "cookies" – small text files that are stored on your computer’s hard drive. We may also use cookies for users of our public website.

We cannot use cookies to access data from your hard drive, to learn your e-mail address, or to view data in cookies created by other web sites. Cookies only store information that a web server places in them. We may use cookies to help us determine the type of content and sites to which a user to our website links, the length of time each user spends at any particular area of our site and which services our users choose to use, among other things. There are 2 types of cookies. Temporary cookies exist only while users are working with our application or are logged on to our website. Persistent cookies are saved on users' hard disks. I*LEVEL's web-native application uses both types of cookies, and our public website may use either or both types of cookies from time to time.

I*LEVEL uses cookies for various reasons. Among other reasons, we use custom-created "persistent" cookies to prevent our customers' employees and employment candidates from completing the same assessment more than once. For example, our software saves a cookie to tell us that an employee has already finished a customer's Retention Assessment on that computer; when we find that cookie on the PC, we prevent the employee from answering the questions again. These persistent cookies have an expiration date set to 90 days, at which time the operating system will automatically delete them.

I*LEVEL uses temporary or "sessional" cookies, among other things, to help our customers' employees and employment candidates navigate around the site and to pass information between system functions as they work within our web-native application. Sessional cookies are not stored on the hard drive once they leave the site; the system automatically deletes them when the browser is closed.

With most Internet browsers, users can block all cookies or receive a warning before a cookie is stored. Blocking all cookies will keep people from using our web-native application. Enabling the warning will interrupt you or your employees' work flow with frequent, annoying messages.

How We Track Usage

I*LEVEL tracks user traffic patterns throughout all of our sites. However, we do not correlate this information with data about individual users at our public website. I*LEVEL does break down overall usage statistics according to a user's domain name, browser type, and MIME type by reading this information from the browser string (information contained in every user's browser). We can determine from an IP addreess a user's internet service provider and the geographic location of his or her point of connectivity. We use tracking information to determine, among other things, which areas of our sites users like and don't like based on traffic to those areas. We do not track what individual users of our public website read, but rather how well each page performs overall. This helps us continue to build a better service for our customers. We may provide these types of information to affiliates or current and potential business partners or other third parties.

Encryption and SSL

To protect your information while in transmission between your employees and our web-native application, I*LEVEL automatically encrypts all data using the Secure Sockets Layer protocol (SSL) using encryption keys of 128 bit, 56 bit or 40 bit depending on your browser's capability. In order to provide the best encryption support, I*LEVEL requires the use of Microsoft Internet Explorer versions 5.5 and higher or Netscape Navigator Version 6 or higher.

SSL is a protocol for securing communication between a web browser, and web server. Whenever you access a web server using https, the page you are sent is encrypted, and any information you send to that server is also encrypted.

Before your people even log in to our site, our server checks that they are using an approved browser - one that uses SSL 3.0 or higher.
